Guarantor to be substituted as creditor

(1) After the person giving surety pays or fulfills the obligation to the creditor on behalf of the debtor or the obligation to be fulfilled according to the agreement, the person giving surety shall be replaced as the creditor in relation to such debt or obligation and he can recover the debt from him as well as the creditor or take legal action against the debtor. .
(2) Notwithstanding anything else written in this paragraph, the guarantor shall pay to the guarantor the entire amount of the debt or the obligation fulfilled on behalf of the debtor and the interest or any other fee or amount incurred on behalf of the debtor.
(3) According to sub-section (2), if the debtor has to take legal action due to the non-payment of the amount to be paid, or if any other expenses are incurred, the guarantor shall be entitled to collect such expenses.
